NEW ECUADOR–NETHERLANDS AGREEMENT STRENGTHENS CUSTOMS COOPERATION

On June 19, 2025, Ecuador’s Official Gazette published the International Agreement signed between Ecuador and the Netherlands. This agreement establishes a legal framework for enhanced cooperation between the customs authorities of both countries in the prevention, detection, investigation, and suppression of customs-related offenses.

Through mechanisms of mutual administrative assistance, the agreement aims to bolster enforcement efforts against offenses such as smuggling, document forgery, and under-invoicing—all of which directly affect the lawful circulation of goods and the protection of intellectual and commercial rights.

Key enforcement tools available to customs authorities:

  • Exchange of information on suspicious operations, smuggling routes, and counterfeit or unlicensed goods.

  • Inspection and detention of shipments potentially infringing intellectual property rights.

  • Targeted surveillance of individuals, goods, and means of transport involved in illicit trade.

  • Joint investigations and technical cooperation between customs authorities to improve border enforcement.

Why should your business care?

This agreement represents a strategic opportunity for companies engaged in international trade to:

  • Strengthen the protection of their intellectual property rights.

  • Review their certificates of origin, licenses, and supporting documentation.

  • Assess their supply chains and relationships with third-party vendors in cross-border operations.

  • Strengthen their compliance policies.

The agreement is particularly relevant given that the Netherlands serves as one of Europe’s key logistic hubs and trade gateways. Its implementation positions Ecuador as a reliable partner in international supply chains and could lay the groundwork for future trade and customs facilitation agreements.
