THE ORGANIC LAW AMENDING VARIOUS LAWS ON AGE DISCRIMINATION IN THE WORKPLACE INTRODUCES NEW OBLIGATIONS AND PROHIBITIONS FOR EMPLOYERS IN ECUADOR

On May 14, 2025, the Organic Law Amending Various Laws on Age Discrimination in the Workplace was published in Supplement No. 7 of the Official Register.

 

Below is a summary of the key provisions that private sector employers should be aware of:

 

  1. Mandatory Training


    Employers must provide their workers with at least 10 hours of training on topics such as: improving the work environment, strengthening skills and attitudes, and preventing harassment and discrimination.


  2. Prohibitions for Employers

 

Employers are prohibited from:

 

  • Including age restrictions in job postings, unless the nature of the position justifies it.
  • Limiting access to training, promotion, or other professional opportunities based on age.
  • Requiring private health, life, or critical illness insurance as a condition for hiring.
  • Terminating the employment relationship based on age.
  • Engaging in acts of discrimination, harassment, or workplace violence based on age.

 

Note: Articles 2 and 3 of the Law, which established the mandatory hiring of workers over the age of 40 and the applicable sanctions for non-compliance, were declared unconstitutional by the Constitutional Court through Ruling No. 2-25-OP/25, issued on April 24, 2025.
